Supercars summary of penalties, Bathurst update 4 Final
STEWARDS SUMMARY OF JUDICIAL OUTCOMES, Update #4 FINAL: issued Monday 14th October 2019 at 0740hrs.

Matters from Race 25:
Deputy Race Director Incident Determinations
The DRD investigated an incident on Lap 1 when Car #14, Tim Slade, collided with the wall at Turn 5. A review of Hawk Eye and broadcast footage demonstrated that Car #14 turned in to Car #2, Scott Pye, who was to the right of Car #14. The DRD determined that the Driver of Car #2 committed no breach of the Rules and that the matter did not warrant referral to the Stewards.

On Lap 150 Car #33, Richie Stanaway, and Car #3, Gary Jacobsen, collided at Turn 1 and both Cars became beached in the sand trap at the exit of Turn 1. The DRD investigated the incident and after reviewing Hawk Eye and broadcast footage determined that no Driver was wholly or predominantly to blame for the incident and that the matter did not warrant referral to the Stewards accordingly,

Stewards' Decisions Penalties imposed
On Lap 123 the Race Director deployed the Safety Car after Car #55, Chaz Mostert, and Car #6, Cam Waters, collided at the entry to Turn 21 and both Cars left the track and became beached in the sand trap at the exit to Turn 21 and Car #6 sustained heavy damage and was retired. After reviewing Hawk Eye and broadcast footage of the incident and consulting the DSA, the Stewards were satisfied that the collision was the direct consequence of the Driver of Car #55 having lost control of his Car in the braking zone into Turn 21 and that the Driver of Car #55 had breached Article 2.1.2 of Schedule B2 (Reckless Driving). The Stewards imposed a Pit Lane drive through Penalty on Car #55.

On Lap 133 Car #27 became beached in the sand trap at the exit to Turn 23 as a result of which the Safety Car was deployed. Rule D10.2.2.3 provides that when notified of the SC intervention (by the flag signals and SC boards), all drivers will reduce speed and maintain a maximum distance of 5 Car lengths from the Car in front. When the SC flags and boards were first displayed on Lap 134, Car #12, Fabian Coulthard, was behind Car #17, Scott McLaughlin, with the gap between the two Cars in the order of one second. A review of Hawk Eye footage revealed that when the SC flags and boards were first in sight of the Driver of Car #12, Car #12 was approaching Turn 6. When Car #12 entered the Pit Lane, the gap between Cars #17 and #12 had increased to in the order of 47 seconds and distance between them had increased to in the order of 1km. The rest of the field was banked up behind Car #12, the Drivers obeying the Rule that Cars are not permitted to overtake when the Yellow flag is displayed. The Stewards imposed a Pit Lane drive through Penalty on Car #12 for the Driver's breach of Rule D10.2.2.3.

On Lap 157 the Safety Car was deployed after Car #7, Andre Heimgartner, collided with the wall at Turn 18. Article 5.10 of the Event Supplementary Regulations amended Rule D10.2.3 to provide that in the event of a SC deployment with 8 or less Laps from the end of the Race, any Car that is one or more laps behind the leader must reposition itself by driving through the Pit Lane so that it is not in front of any Car that is not in front of any Car that is on the lead lap. Despite the Race Director issuing a warning to Teams over LAN that any Cars one or more Laps down on the leader were required to go through Pit Lane during the SC deployment and to reposition themselves, Car #8 and Car #19 failed to do so and the Stewards issued a post-race Pit Lane drive through Time Penalty on each Car.

After the Race the Stewards determined to conduct an inquiry into the incident on Laps 134-135 during the Safety Car deployment when the gap between Cars #17 and #12 increased significantly to the disadvantage of all Cars behind Car #12 because they were concerned that the incident may have been the result of Racing Team (Aust) Pty Ltd having issued an instruction to the Driver of Car #12 to slow and create an unwarranted large gap between Cars #17 and Car #12 for tactical reasons.

Rule D24.1 prohibits Team Orders and provides that an instruction to a Driver or Team member, either verbal or otherwise the effect of which may interfere with a race result is a Team Order.

After the Race Director announced the Pit Lane drive through Penalty on Car #12, the Stewards noted on broadcast footage an interview by a Supercars Media commentator of the Authorised Representative of Racing Team (Aust) Pty Ltd, Mr Story, during which Mr Story was invited to explain the reason why the gap between Cars #17 and #12 had been so large and whether it was the result of a 'plan'. While denying that suggestion, the response of Mr Story and the extraordinary increase in the gap between Cars #17 and #12 during the SC deployment caused the Stewards to hold concerns that Rule D24.1 may have been breached.

Following the Race the Stewards summonsed the Authorised Representative of Racing Team (Aust) Pty Ltd, the Driver of Car #12 and Car #12's engineer to a Hearing and requested that the DRD obtain a recording of the radio communications between Car #12 and Car #12's engineer during the SC deployment. That Hearing commenced at 2000hrs on Sunday 13 October. After interviewing Mr Story, the Driver of Car #12 and Car #12's engineer, and reviewing Hawk Eye footage of the incident, including in-Car footage from Car #12, the interview of Mr Story and Supercars telemetry data for Car #12, the Stewards, while making no findings, determined that the evidence was sufficient to call upon Racing Team (Aust) Pty Ltd to answer whether it breached Rule D24.1 and recommended to the DRD that he consider laying a charge of a breach of that Rule. The DRD having determined to lay such a charge, and the Authorised Representative of Racing Team (Aust) Pty Ltd having explained that he required an opportunity gather and present evidence in defence of that charge and the DRD having sought an opportunity to secure further evidence, the Stewards closed the Inquiry at 2210hrs. The charge will be heard by a panel of Stewards prior to the commencement of track activities at the forthcoming Gold Coast 600. In the circumstances, the Classifications for Race 25 remain Provisional.

The Stewards re-iterate that no findings have been made against Racing Team (Aust) Pty Ltd at this stage and the Driver of Car #12 is not accused of any breach of the Rules beyond the breach of Rule D10.2.2.3 for which a Pit Lane drive through Penalty was issued during the Race and was served.

During the Session the Stewards deleted a Lap time for Car #56, Brodie Kostecki, after Car #56 was observed to have exceeded track limits at the exit of Turn 21 and to have re-joined the circuit at the exit of Turn 22. While several other Cars were observed to have exceeded the track limits at Turn 21 during the Session, timing confirmed that Car #56's Lap time for the Lap concerned was faster than any of Car #56's previous Lap times in the Session which demonstrated that Car #56 had gained an advantage as a result of short-cutting the circuit.

Following the Session the DRD conducted an investigation into a suspected breach of Rule A4.4 by Kostecki Bros Racing after Car #56 collided with the wall at Turn 2 on its out Lap at the commencement of the Session. A report from Supercars Technical confirmed that Car #56 had been released from its Pit bay with a rack stop left in on the steering rack as a result of which the Driver of Car #56 was unable to turn the Car to the right. After an admission to the breach, the Stewards imposed a Penalty on Kostecki Bros Racing of a Fine in the sum of $5,000, of which $3,500 is suspended until 31 December 2019 on condition that Kostecki Bros Racing commits no further breach of Rule A4.4 prior to that date, and the loss of fifty (50) Team Championship Points.
